  5. SECTION 18-5.5-101. Definitions
  6.  
  7.      As used in this article, unless the context otherwise 
  8. requires:
  9.  
  10.      (1) "Authorization" means the express consent of a person 
  11. which may include an employee's job description to use said 
  12. person's computer, computer network, computer program, computer 
  13. software, computer system, property, or services as those terms 
  14. are defined in this section.
  15.  
  16.      (2) "Computer" means an electronic device which performs 
  17. logical, arithmetic, or memory functions by the manipulations of 
  18. electronic or magnetic impulses, and includes all input, output, 
  19. processing, storage, software, or communication facilities which 
  20. are connected or related to such a device in a system or network.
  21.  
  22.      (3) "Computer network" means the interconnection of 
  23. communications lines (including microwave or other means of 
  24. electronic communication) with a computer through remote 
  25. terminals, or a complex consisting of two or more interconnected 
  26. computers. 
  27.  
  28.    (4) "Computer program" means an series of instructions or 
  29. statements, in a form acceptable to a computer, which permits the 
  30. functioning of a computer system in a manner designed to provide 
  31. appropriate products from such computer system. 
  32.  
  33.      (5) "Computer software" a set of computer programs, 
  34. procedures and associated documentation concerned with the 
  35. operation of a computer system.
  36.  
  37.      (6) "Computer system" means a set of related, connected or 
  38. unconnected computer equipment, devices and software. 
  39.  
  40.      (7) "Financial instrument" means any check, draft, money 
  41. order, certificate of deposit, letter of credit, bill of 
  42. exchange, credit card, debit card, or marketable security.
  43.  
  44.    (8) "Property" includes but is not limited to, financial 
  45. instruments, information, including electronically produced data, 
  46. and computer software and programs, in either machine human 
  47. readable form, and any other tangible or intangible item of 
  48. value.

  50.      (9) "Services" includes, but is not limited to, computer 
  51. time, data processing and storage functions.
  52.  
  53.      (10) To "use" means to instruct, communicated with, store 
  54. data in, retrieve data from, or otherwise make use of any of the 
  55. resources of a computer, computer system, or computer network.
  56.  
  57. SECTION 18-5.5-102. Computer crime 
  58.  
  59.      (1) Any person who knowingly uses any computer, computer 
  60. system, computer network, or any part thereof for the purpose of 
  61. devising or executing any scheme or artifice to defraud; 
  62. obtaining property or services, by means of false or 
  63. fraudulent pretenses, representations or promises; using the 
  64. property or services of another without authorization; or 
  65. committing theft commits computer crime.
  66.  
  67.      (2) Any person who knowingly and without authorization, uses  
  68. alters, damages, destroys any computer, computer system, computer 
  69. network, described in section 18-5.5-101, or any computer 
  70. software, program or data contained in such computer, computer 
  71. system or computer network commits computer crime.
  72.  
  73.      (3) If the loss, damage, or thing of value taken in 
  74. violation of this section is less than fifty dollars, computer 
  75. crime is a class 3 misdemeanor; if fifty dollars or more but less 
  76. than three hundred dollars, computer crime is a class 2 
  77. misdemeanor; if three hundred dollars or more but less than ten 
  78. thousand dollars, computer crime is a class 4 felony; if ten 
  79. thousand dollars or more, computer crime is a class 3 felony.
